POOFICIENT TERMS OF USE

Thank you for using Pooficient! We built this app to help you track and understand your child's digestive health. Because we can't know every family personally, we have these Terms of Use to help keep things running smoothly.
When we say "Pooficient", "we", "our", or "us", we're referring to Pooficient (operated by Pediatrik Sağlık Teknolojileri A.Ş.).
When we say "App", we mean the Pooficient mobile application and all its features.
When we say "you" or "your", we're referring to the person who owns a Pooficient account.
We may update these Terms in the future. When we make significant changes, we'll notify you through the App or by email and refresh the date at the top of this page.
When you use the App, now or in the future, you're agreeing to the latest Terms. If we don't exercise or enforce a right under these Terms, that doesn't mean we're waiving it. These Terms do contain a limitation of our liability.
What Pooficient Is (And Isn't)
Pooficient is a tracking tool. Think of it as a digital health journal for your child's digestive health. We help you log bowel movements, symptoms, and patterns so you can share organized information with your pediatrician.
What we provide:
Digital logbook for tracking
Photo storage and organization
Pattern visualization
AI-generated summaries of your logged data
Educational content about digestive health
Exportable reports
What we do NOT provide:
Medical advice, diagnosis, or treatment
Healthcare or telemedicine services
Emergency services
Doctor-patient relationships
Guaranteed detection of health problems
🚨 IMPORTANT: Pooficient is NOT a substitute for medical care. Always consult your pediatrician for health concerns. In emergencies, call 911 immediately.
About AI Features: Our AI analyzes patterns in the data YOU log. These are automated summaries, not medical evaluations. They may be inaccurate or incomplete. Never rely on AI outputs for medical decisions. The absence of alerts doesn't mean everything is fine.
Account Terms
You're responsible for your account.
You must be 18 or older and the parent/legal guardian of the child you're tracking
You're responsible for maintaining account security and password confidentiality
You're responsible for all activity under your account
You're responsible for all medical decisions regarding your child's health
You must be a human - accounts registered by bots aren't permitted
Your Content
You own the content you upload.
All photos, logs, notes, and data you upload ("Your Content") belong to you. However, by using the App, you give us permission to:
Store and process Your Content to provide App features
Use Your Content to train and improve our AI systems
Create anonymized, aggregated data for research and product development
Back up Your Content for security
We do not sell your identifiable health data to third parties.
Important: De-identified data (data stripped of personal identifiers) may be retained permanently for AI training and research, even after you delete your account.
Content Rules - Read This Carefully
You may ONLY upload content about YOUR OWN CHILD.
Regarding photos, you specifically agree:
Upload only stool photos necessary for tracking
Do NOT upload photos showing your child's face, body, or identifiable features
Do NOT upload photos of other people's children
Do NOT upload inappropriate or sexually explicit images
Do NOT upload photos showing genitalia beyond what's minimally necessary for stool documentation
We use automated systems to detect prohibited content. Accounts that upload inappropriate content will be immediately terminated, and we'll report suspected violations to authorities as required by law.
Your child's future rights: When your child turns 18, they may request access to or deletion of data you uploaded about them. You're responsible for considering their future privacy interests now.
Things You Can't Do
You agree not to:
Violate any laws
Upload illegal, harmful, or inappropriate content
Reverse engineer or tamper with the App
Use bots or automated tools
Share your account
Use the App to compete with us
Interfere with App functionality or security
Violations can result in immediate account termination.
Not Medical Advice
The App is a tracking tool, not a medical service.
Nothing in the App constitutes medical advice, diagnosis, or treatment. We're not healthcare providers. We don't create doctor-patient relationships.
Never delay seeking medical care because of something in the App.
If your child shows concerning symptoms - blood in stool, severe pain, high fever, dehydration, lethargy, or anything that worries you - seek immediate medical care.
If you share App reports with healthcare providers:
This is your decision and responsibility
We're not liable for how providers use or interpret the information
Providers shouldn't rely solely on App data for clinical decisions
App data is patient-reported information only
Payments and Cancellation
Payments: All subscriptions are processed through Apple or Google. We don't handle payments directly.
Refunds: Governed exclusively by Apple's or Google's refund policies. We can't provide direct refunds.
Canceling subscription:
iOS: Settings → Subscriptions → Pooficient → Cancel
Android: Google Play → Subscriptions → Pooficient → Cancel
Canceling your subscription doesn't delete your account. To delete your account, use the in-app deletion feature.
Account deletion: You can delete your account anytime through in-app settings. When you do:
Active data is removed
Backup copies persist for up to 90 days
Anonymous data may be retained
We can't delete data you've already shared with others
Uptime, Security, and Privacy
Your use of the App is at your sole risk. We provide the App "as is" and "as available". We take uptime seriously but don't guarantee uninterrupted service.
Security: We use industry-standard security measures including encryption, but no system is 100% secure. You're responsible for keeping your password secure.
Your backup responsibility: We're not liable for data loss. Regularly export and save copies of important data.
Privacy: We take your trust seriously. We process your data as described in our Privacy Policy and for no other purpose. Our team can access your data only:
To help with support requests (with your consent)
To fix rare system errors (accessing minimal data necessary)
To ensure security and prevent abuse
When required by law
We use third-party vendors for hosting, software, networking, and storage. Under California law (CCPA), we're a "service provider" processing data only for the purpose you signed up for.
Copyright and Ownership
You own your content. We claim no ownership over your uploaded data.
We own the App. All rights to the App - including design, software, logos, and trademarks - belong to us. You get a limited license to use the App for personal, non-commercial purposes only.
You can't duplicate, copy, or reuse any part of the App's design, code, or visual elements without our written permission.
Features and Bugs
We design the App carefully based on our experience and user feedback. However, no app pleases everyone. We make no guarantees the App will meet your specific expectations.
Like all software, our App has bugs. We track reported bugs and prioritize fixes, especially security-related ones. Not all bugs will get fixed, and we don't guarantee error-free service.
Liability
Read this carefully:
You understand and agree that Pooficient shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Medical outcomes, delayed diagnosis, or health complications
Inaccurate AI outputs or failure to detect patterns
Data loss or security breaches beyond our control
Reliance on App content
Healthcare provider decisions based on App data
Loss of profits, data, or other losses
Our total liability is limited to the greater of $100 or the amount you paid us in the past 12 months.
These limitations apply even if we've been advised of possible damages.
In other words: Choosing to use our App means you're making a bet on us. If it doesn't work out, that's on you, not us. We work hard to be as safe a bet as possible, but we can't guarantee outcomes. If you choose to use Pooficient, thank you for betting on us.
Your Responsibilities
You agree to defend and hold us harmless from any claims, damages, or costs (including attorneys' fees) arising from:
Your use of the App
Your uploaded content
Your violation of these Terms
Healthcare provider reliance on App data
Claims by your child regarding data you uploaded
Termination
We can suspend or terminate your account for violations of these Terms, fraud, security concerns, or at our discretion. We'll try to be fair, but some things we stand against, and this is how we exercise that stance.
You can cancel anytime using in-app settings.
Upon termination:
Your access ends immediately
Data is deleted per our retention policy
No refunds (subject to app store policies)
Disputes
US Users: Delaware law governs these Terms. Disputes must be resolved through binding arbitration (AAA Consumer Arbitration Rules), not court, except for small claims or IP disputes. No class actions. Claims must be filed within 1 year. You can opt out within 30 days by emailing developer@pediatricstechnologies.com with subject "Arbitration Opt-Out".
Non-US Users: Your local consumer protection laws govern. You can bring claims in your local courts.
EU/EEA/UK Users: You have additional GDPR rights including access, deletion, correction, portability, and objection. Your mandatory consumer rights can't be waived.
General
Entire Agreement: These Terms are the complete agreement between you and Pooficient.
Changes: We may modify the App or these Terms at any time. Material changes will be communicated.
Severability: If any provision is unenforceable, the rest remains in effect.
Assignment: We can assign these Terms; you can't without our consent.
